الحمد لله رب العالمين، وأصلي وأسلم على نبينا محمد وعلى آله وأصحابه أجمعين.
أما بعد.
فقد روى عبد الرزاق عن ابن جريج قال : قلت لعطاء : أكانت الحائض تُؤمَر أن تتوضأ عند وقت كل صلاة ، ثم تجلس فَتُكَبِّر وتَذْكُر الله ساعة ؟ قال : لم يبلغني في ذلك شيء ، وإن ذلك لَحَسَن، قال معمر: وبلغني أن الحائض كانت تُؤمَر بذلك عند وقت كل صلاة([1]).
قال ابن عبد البر :من السلف مَن كان يَرَى للحائض ويأمرها أن تتوضأ عند وقت الصلاة، وتذكر الله ، وتستقبل القبلة ذَاكِرَة لله جالسة.
وروى خالد عن عقبة بن عامر ومكحول قال مكحول : كان ذلك من هدي نساء المسلمين في أيام حيضهن.
ثم قال ابن عبد البر : هو أمْر مَتْرُوك عند جماعة الفقهاء ، بل يكرهونه.
وقال: ذكر دحيم قال حدثنا محمد بن عبد الله الأنصاري عن سليمان التيمي قال سئل أبو قلابة عن الحائض إذا حضرت الصلاة أتتوضأ وتذكر الله فقال أبو قلابة قد سألنا عنه فلم نجد له أصلاً.
قال دحيم: وحدثنا الوليد بن مسلم قال سألت سعيد بن عبد العزيز عن الحائض أنها إذا كان وقت صلاة مكتوبة توضأت واستقبلت القبلة فذكرت الله في غير صلاة ولا ركوع ولا سجود قال ما نعرف هذا ولكنا نكرهه
وقال معمر قلت لابن طاوس أكان أبوك يأمر الحائض عند وقت كل صلاة بطهر وذكر قال: لا .
وعلى هذا القول جماعة الفقهاء وعامة العلماء اليوم في الأمصار، اهـ ([2]).
* وذَكَر الإمام النووي الخلاف في وضوء الْجُنُب والْحِكْمَة مِنه، ثم قال: قال المازري : ويَجْري هذا الخلاف في وضوء الحائض قبل أن تنام؛ فمن عَلّل بِالْمَبِيت على طهارة اسْتَحَبّه لها، هذا كلام المازري.
وأما أصحابنا فإنهم مُتَّفِقُون على أنه لا يُسْتَحَب الوضوء للحائض والنفساء؛ لأن الوضوء لا يُؤثِّر في حَدَثهما، فإن كانت الحائض قد انقطعت حيضتها صارت كَالْجُنُب([3]).
قال ابن قدامة:"فإن اغتسلت للجنابة في زمن حيضها صح غسلها، وزال حكم الجنابة، وحكم الحيض لا يزول حتى ينقطع الدم، لأن أحد الحدثين لا يمنع ارتفاع الآخر"([4]).
ولكن هذا الوضوء، وهذا الغسل لا يبيح أي منهما ممارسة العبادة الممنوعة بمقتضى الحدث، ولم نطلع على شيء يبيح وضوء الحائض، والأصل في العبادات التوقيف.
ومما سبق يتبين: أنه ليس للحائض أن تتوضأ للنوم، لأنه لم يرد في وضوئها شيء فيما اطلعنا عليه من المراجع، وإلحاقها بالجنب ينافيه أمران:
الأول: أن العبادات مبناها على التعبد، فالأصل أن لا تعلل، والقياس لا يتم إلا في المعللات، فالعلة فيه ركن ركين.
الثاني: أنه على افتراض إمكان القياس هنا، فإنه قياس مع وجود الفارق، وهو أن الجنب شرع له التخلص من جنابته في كل وقت، بخلاف الحائض فإنها لا يشرع لها التخلص من حدثها إلا بعد انقطاع دم الحيض، وجفوف المحل، أو ظهور القصة البيضاء، يضاف إلى هذا أن حدث الحيض أغلظ من حدث الجنابة، فقد لا يجدي فيه ما يجدي في الجنابة.والله أعلم.
